Terms of Use

These Terms are an agreement between you and Passport Pours LLC, a Wyoming limited liability company ("we", "us"), about your use of the Passport Pours app and website. By creating an account or using the app, you agree to them.
1. Who can use Passport Pours
You must be of legal drinking age where you live, never younger than 18, and at least 21 in the United States. By using the app you confirm that you are.
2. Your account
Keep your sign-in details private; you are responsible for activity on your account. One person per account. You can delete your account at any time in the app (Profile → Delete account).
3. Drink responsibly
Passport Pours is a journal and discovery tool for adults. It helps you record drinks you choose to try; it never tells you to drink, how much to drink, or when. We do not encourage excessive or underage drinking, and nothing in the app is medical, health, or nutritional advice.
Your choices are yours. You alone are responsible for whether, what, where and how much you drink, and for what you do afterward. Never drink and drive, and follow the laws where you are, including local drinking ages and rules about where alcohol may be bought or consumed.
Check before you drink. Drink details in the catalog (such as alcohol content, ingredients, allergens and country of origin) come from other users and outside databases and may be incomplete or wrong. Food pairings and trip drink lists are suggestions written by AI and may also be wrong or unavailable where you are. Always check the label, ask the seller, and check local laws before relying on anything in the app.
Age. By using the app you confirm that you are of legal drinking age where you live, never younger than 18, and at least 21 in the United States. If you are not, you may not use Passport Pours.
If you're worried about your drinking or someone else's, help is free and confidential: in the US, call the SAMHSA National Helpline at 1-800-662-4357 (24/7), or contact your local health service.
4. Your content
Your journal. Your tastings, notes, photos and lists belong to you. Unless you share them (section 5), they are visible only to you. You give us permission to store and process them solely to provide the app to you.
Shared catalog. When you add or confirm a beverage (name, details, product photo), you give us a worldwide, non-exclusive, royalty-free license to display, adapt and distribute that information to other users as part of the catalog, including after you delete your account (without your name attached).
Your responsibility. Only upload content you have the right to share. Do not upload anything unlawful, offensive, infringing, or that shows other people without their consent.
5. Community
Community (following, sharing tastings, Cheers and Alerts) is optional. To join, you choose a username and agree to the Community Rules below.
What you share. When a tasting is shared, the whole tasting (drink, rating, notes, food pairing, location you typed, story and photos) is visible to your followers, and your map, stamps and badges are visible to them too. New tastings are shared by default; you can switch sharing off on any tasting at any time. Your account is private unless you make it public. The Privacy Policy explains exactly who sees what.
Licence for shared content. You keep ownership of what you share. You give us a non-exclusive, royalty-free licence to store and display it to the people you've allowed to see it, only for running Passport Pours. The licence ends when you stop sharing the tasting, delete it, or delete your account (except for copies kept in backups for a limited time, or when we must keep it for legal reasons).
Community Rules. When using Community you must:
- Be of legal drinking age where you live (never under 18; 21+ in the United States).
- Be kind: no harassment, hate, threats or bullying.
- Keep it clean: no nudity, sexual or violent content.
- Drink responsibly: don't promote drunk driving, binge drinking or drinking by minors.
- Not post spam or advertising, or offer to sell alcohol.
- Only share photos you took, and never share other people's private information.
There is zero tolerance for objectionable content or abusive users.
Reporting and blocking. You can report any shared tasting or person from the ⋯ menu, and block anyone. Blocking takes effect immediately: follows between you are removed and neither of you can find or see the other in Community.
Moderation. We don't review content before it's shared, but we review reports and aim to act within 24 hours. We may remove content, and suspend or delete accounts, that we believe break these Terms or the Community Rules. When we do, we'll tell you what we removed and why, unless the law or someone's safety prevents it. If you think we got it wrong, reply to that message or email hello@passportpours.com and we'll take another look. We may also report illegal content to the authorities.
Other users. Content shared by other users is theirs, not ours, and we don't endorse it. You're responsible for your own interactions with other users.
6. Acceptable use
Don't misuse the service: no scraping, reverse engineering, overloading our systems, creating fake or impersonation accounts, collecting other users' information, or using the app to break the law.
7. Product information
Beverage information comes from users and from Open Food Facts (openfoodfacts.org), whose data is available under the Open Database License, and from UPCitemdb. It may be incomplete or wrong. Always check the label, especially for allergens or alcohol content. The app credits Open Food Facts on beverages whose data came from it.
8. Beta testing
Early versions (including TestFlight builds) may have bugs, change without notice, or lose data. Please send feedback to hello@passportpours.com (also under Profile → Help & feedback).
9. Ending use
You can stop using the app at any time and delete your account in the app. We may suspend or close accounts that break these Terms or the Community Rules.
10. Disclaimers and limitation of liability
The app is provided "as is" without warranties of any kind. We are not responsible for content posted by other users. To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability to you for all claims is limited to the greater of USD 50 or the amount you paid us in the 12 months before the claim arose.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, such as liability for death or personal injury caused by negligence, for fraud, or, where applicable, for gross negligence or intentional misconduct. If you live in a country whose consumer laws give you rights that these Terms cannot take away, those rights still apply.
11. Governing law
These Terms are governed by the laws of the State of Wyoming, USA, and disputes will be handled in the state courts of Sheridan County, Wyoming, or the United States District Court for the District of Wyoming, unless your local law gives you the right to bring claims where you live.
12. Apple and Google
If you downloaded the app from the Apple App Store or Google Play, their terms also apply. On Apple devices, your licence to use the app is Apple's Licensed Application End User License Agreement; these Terms cover how you use the Passport Pours service.
If you got the app from the Apple App Store:
- These Terms are between you and Passport Pours LLC, not Apple. We, not Apple, are solely responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to meet any applicable warranty, you may notify Apple and Apple will refund any purchase price (the app is free); to the extent permitted by law, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for handling any claims about the app, including product-liability claims, claims that the app breaks a law or regulation, and consumer-protection claims.
- If anyone claims the app or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Google is likewise not responsible for the app or its support.
13. Changes
We may update these Terms. We'll post the new version with a new "Last updated" date, and notify you of significant changes.
